1. Important Notice
This Regulatory Disclosure provides important information about the nature and status of ClassEngine.eu and the services we provide. Please read this document carefully.
ClassEngine.eu is not a law firm. We do not provide legal advice, legal opinions, or legal representation. We are a technology platform that connects consumers with independent law firms.
2. Nature of the Platform
ClassEngine.eu, operated by [ClassEngine Operating Entity], is a lead generation and consumer aggregation platform. Our role is to:
- Identify systemic corporate and regulatory breaches that may give rise to collective redress claims
- Provide information to consumers about their potential rights and the availability of collective redress
- Aggregate affected consumers into organised groups
- Connect those groups with independent, qualified law firms that specialise in collective redress
- Provide case status updates and communications to registered consumers
We do not assess the merits of any individual claim. We do not provide legal advice or recommendations. All legal assessments, advice, and representation are provided exclusively by our independent partner law firms.
3. The Representative Actions Directive (2020/1828)
Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers (the “Representative Actions Directive” or “RAD”) establishes a harmonised EU framework for collective redress.
3.1 Overview of the Directive
The RAD:
- Enables “qualified entities” to bring representative actions on behalf of groups of consumers whose collective interests have been harmed
- Covers both injunctive measures (to stop harmful practices) and redress measures (to obtain compensation, repair, replacement, price reduction, or reimbursement)
- Applies to infringements of over 60 EU legislative instruments across areas including data protection, financial services, consumer rights, energy, telecommunications, and more
- Requires EU Member States to ensure that at least one effective procedural mechanism for representative actions is available
3.2 Our role under the RAD
ClassEngine.eu is not a “qualified entity” under the Representative Actions Directive. We do not bring representative actions ourselves.
Our role is to support the ecosystem created by the RAD by:
- Making consumers aware of their rights under the Directive and its national implementing legislation
- Aggregating affected consumers to enable efficient collective redress
- Connecting consumer groups with qualified entities and law firms that may bring representative actions on their behalf
- Ensuring that consumer data is managed in compliance with GDPR and to the standards required by institutional litigation funders
3.3 National implementation
EU Member States were required to transpose the RAD into national law by 25 December 2022, with application from 25 June 2023. The specific rules and procedures for representative actions vary by jurisdiction. Our partner law firms are familiar with the national implementing legislation in each jurisdiction in which we operate.
4. Jurisdictions
ClassEngine.eu currently operates in the following jurisdictions:
4.1 Active jurisdictions
- Ireland: Governed by the Representative Actions for the Protection of the Collective Interests of Consumers Act 2023 and supervised by relevant authorities including the Data Protection Commission and the Competition and Consumer Protection Commission
- United Kingdom: While no longer an EU Member State, the UK has its own collective action framework. Claims may be brought under the Consumer Rights Act 2015, the Competition Act 1998, and related legislation. The UK is not subject to the RAD, but similar mechanisms exist
- Portugal:Governed by the transposition of the RAD into Portuguese law and the existing Popular Action Law (Lei n.º 83/95)
4.2 Planned expansion
We are expanding to additional EU jurisdictions including Spain, Italy, the Netherlands, and Germany. Each expansion is subject to regulatory assessment and the establishment of appropriate partner law firm relationships in the relevant jurisdiction.
5. Partner Law Firms
All legal services associated with claims facilitated through ClassEngine.eu are provided by independent partner law firms. These firms:
- Are regulated by the appropriate legal regulatory authority in their respective jurisdictions
- Maintain professional indemnity insurance as required by their regulators
- Enter into a separate client engagement letter or retainer agreement directly with you
- Are solely responsible for all legal advice, case assessment, and litigation strategy
- Operate independently from ClassEngine.eu in all legal matters
ClassEngine.eu does not influence, direct, or control the legal advice or litigation strategy of any partner law firm. The solicitor-client relationship is between you and the law firm, not between you and ClassEngine.eu.
6. Litigation Funding
Some cases facilitated through our Platform may be supported by third-party litigation funders. Where litigation funding is involved:
- The funder provides capital to cover legal costs and disbursements
- The funder receives a share of any successful outcome, as agreed between the funder, the law firm, and the consumer group
- You will be informed of any litigation funding arrangement before you are asked to consent to it
- Litigation funders are subject to their own regulatory requirements and codes of conduct
ClassEngine.eu does not provide litigation funding and is not a litigation funder.
7. Financial Arrangements and Revenue
ClassEngine.eu generates revenue through arrangements with partner law firms and, in some cases, litigation funders. These arrangements may include:
- Referral fees or introduction fees paid by partner law firms for connecting them with qualified consumer groups
- Case facilitation fees based on the size or outcome of cases
- Platform licensing or access fees
ClassEngine.eu does not charge consumers any fee for using the Platform. You will never be asked to pay us directly.
All financial arrangements are disclosed to partner law firms and, where relevant, to litigation funders. These arrangements do not affect the independence of the legal advice provided by partner law firms.
8. No Guarantees
ClassEngine.eu does not guarantee:
- That registration on the Platform will result in connection with a law firm
- That any case will be pursued
- That any claim will be successful
- Any particular outcome, settlement amount, or timeline
- That a litigation funder will be found for any particular case
Past results in similar cases are not a guarantee of future outcomes. Each case is assessed on its own merits by the relevant partner law firm.
9. Conflicts of Interest
We are committed to managing potential conflicts of interest transparently:
- We do not favour one partner law firm over another based on the fees they pay us
- Consumer groups are matched to law firms based on the firm’s expertise, jurisdiction, and capacity
- Where we identify a potential conflict of interest, we will disclose it and take appropriate steps to manage it
10. Complaints
